Purpose

These terms govern the use of Bercio, a baby monitor app working between two phones, published by Tequi (Charles Grimont). By using the app, you accept them.

A help, not a guarantee

Bercio is not a medical device. It monitors neither breathing nor heart rate and does not prevent sudden infant death.

An alert may be missed or delayed: Wi-Fi or mobile network down, flat battery, notifications turned off, power saving mode, the phone closing the app, a cry the detection does not recognise. The app never replaces adult supervision or safe sleep recommendations.

Conditions of access

To use the app, you must:

  • be of legal age;
  • use devices you own or are allowed to use;
  • only film your own child, or a child whose parents have agreed, and inform anyone who may be seen or heard (childminder, family).

Good practice

  • Place the baby device more than one metre from the bed, with cable and charger out of the child's reach.
  • Check before each night that the alerts ring (“Test alerts” in the settings) and that the baby device is plugged in.
  • On Android, turn off battery optimisation for Bercio if the phone's maker closes apps in the background.

Prohibited uses

  • Filming or listening to a person without their knowledge.
  • Diverting the app from its purpose, copying it, decompiling it or trying to circumvent how it works.
  • Disrupting the connection services it uses.

Free of charge, with ads

The app is free. It is funded by a banner ad shown on the parent device (see the privacy policy).

Availability

The app depends on the network and on third-party services (PeerJS connection, Google). The publisher does not guarantee continuous operation and may change, suspend or discontinue the app.

Liability

To the extent permitted by law, the publisher cannot be held liable for damage resulting from a missed or delayed alert, an interruption of the service or a use that does not comply with these terms. These terms do not limit the rights you have under the law as a consumer.

Changes

These terms may change; the version in force is published in the app and on its website, with its update date. Continuing to use the app means accepting the new version.

Governing law and disputes

These terms are governed by French law. In case of dispute, an amicable solution is sought before any action; failing that, the French courts have jurisdiction, subject to the rules protecting consumers.
